Desjardins reserves the right to change the terms and conditions at any time without advance notice. In such cases, Desjardins may post change notices directly on the site or may insert links to such change notices.
The site and site use will be governed by and construed in accordance with the laws of the province of Quebec. All disputes, controversies, or claims arising out of or in connection with the site shall be submitted to and be subject to the jurisdiction of the courts of the province of Quebec and by applicable Canadian laws. 1. Description of services
Desjardins currently provides users with a wide selection of online services. These include communication tools (e.g. desjardins.com) and transactional tools (e.g. AccèsD)(hereinafter collectively "the Service").
You alone are responsible for paying the costs associated with use of the Service, such as Internet connection charges or fees charged for connecting to networks that provide access to Internet content. As well, you are responsible for acquiring any equipment needed for such connections.
2. User identification
You are not required to identify yourself when making use of the Service, except when such identifying information is required to access the site's transactional tools. At the same time, the more accurate, complete and current your personal information, the easier it will be to tailor the Service to your requirements.

Desjardins is keenly aware of the need to protect your security and privacy, particularly in regard to any information you provide to Desjardins while making use of the Service.

Desjardins is concerned about protecting children who use this site. You alone are responsible for protecting the confidentiality of your user code and password as well as any actions undertaken under your identification or password.
Moreover, you are responsible for immediately notifying Desjardins about any unauthorized use of your user ID or passwords and any other security breach, as well as for taking every possible precaution to ensure that you use the Service under optimal security conditions.

Any dealings with merchants relative to the Service are strictly between you and the merchants concerned. 2. Respecting the terms and conditions
2.1 The cardholder acknowledges having in his/her possession a user code and password linked to his/her card. If the cardholder has more than one personal credit card issued by Desjardins, he/she acknowledges that one user code and one password give him/her access to all his/her accounts via AccèsD using any accessible system.
2.2 The cardholder also acknowledges that the use of his/her card, as well as the transactions carried out with it are subject to terms and conditions enacted by Desjardins from time to time and agrees to respect, among others, the terms and conditions set forth hereafter.
3.1 The cardholder acknowledges that use of his/her user code together with his/her password is equivalent to his/her authentic signature allowing him/her to carry out various transactions with Desjardins via accessible systems (e.g.: access to information, change of address, credit limit increase).
3.2 Through each accessible system, Desjardins will indicate the following to the cardholder: i) the types of transactions that may be carried out, which can vary depending on the system used; ii) the accounts that may be used to carry out these transactions; iii) the instructions allowing completion of a transaction.
4. Password confidentiality
4.1 The Fédération will provide the cardholder with a temporary password to be used in conjunction with the user code assigned to him/her. This password must be modified by the cardholder during his/her initial use of the service. The cardholder agrees not to choose a password that can easily be guessed (e.g.: birth date, address, postal code), in which case he/she would be considered to have contributed to the unauthorized use of the user code.
4.2 The cardholder agrees not to disclose his/her password to anyone, in any way and not to write it on the card itself or on any document that is easily accessible, in which case he/she will assume the full responsibility of doing so, including transactions carried out in contravention of this agreement or fraud perpetrated using this password.
4.3 In the event that the cardholder realizes the confidentiality of his/her password has been lost or compromised or as soon as a third party is suspected of knowing the password, the cardholder agrees to change it immediately. Failure to do so will render him/her responsible for any damages related to transactions carried out using this password.
5. Transaction confirmation
5.1 The cardholder recognizes that the confirmation number issued by an accessible system constitutes the proof that the transaction has been correctly recorded.
5.2 Desjardins, although it may do so, is not legally required to provide another proof of transaction unless needed by the cardholder to avoid or settle a dispute. If this is the case, the cardholder must provide Desjardins with the transaction's confirmation number. The cardholder accepts that the magnetic stripe or equivalent information medium on which data relating to the transaction is recorded constitutes sufficient written proof of a transaction in any legal proceedings.
6. Transaction accuracy
6.1 The cardholder accepts that the accuracy of transactions carried out with his/her access code and password using any accessible system is subject to verifications and authorizes Desjardins to make the necessary adjustments in the account associated with the card to which the user code used for the transaction is linked in the event of a mistake or inaccuracy, within 10 business days of such transaction.
7.1 Desjardins cannot assure the confidential nature of transactions carried out by the cardholder using a non-secure system or if the user has not complied with the provisions relating to password confidentiality described in section 4.2 of this document and the security measures spelled out in this site's security policy.
8.1 The cardholder recognizes that Desjardins cannot be held responsible for damages, including monetary losses, arising from the impossibility to use an accessible system due to malfunction, temporary downtime or misuse or any other service interruption of such systems caused by actions outside of Desjardins' control, including industrial disputes and equipment failure. However, the cardholder shall not be held responsible for monetary losses resulting from technical malfunctions within Desjardins' information technology system.
8.2 The cardholder will not be held responsible for transactions carried out after he/she was threatened and obligated to divulge his/her password and user code, providing a complaint is filed with law enforcement, the Fédération is immediately notified and full cooperation is given with any ensuing investigation.
8.3 The cardholder agrees to notify Desjardins of any changes to his/her personal information that could affect the transactions carried out using his/her user code and password (e.g.: address, telephone number). The cardholder recognizes that Desjardins cannot be held responsible for damages ensuing from his/her failure to provide updated information, such as interest charges or fees sent to the cardholder by a product or service provider.
9. Changes to the terms and conditions
9.1 The cardholder recognizes that the Fédération can modify these terms and conditions unilaterally and without advance notice. The Fédération informs the cardholder of the changes, and the latter must accept them following the procedure indicated by the Fédération to be able to continue using AccèsD.
10. User code cancellation
10.1 The cardholder may cancel his/her user code and terminate this agreement at any time by contacting the Fédération according to the instructions provided in Article 11.
10.2 Desjardins may also cancel a user code it issued and terminate this agreement at any time, in which case it will not be held responsible for any losses resulting from this action.
